We are glad to inform you that the Kerala Advocates’ Welfare Fund Trustee
Committee at its emergent meeting held on 1st July, 2022, accorded sanction to grant monthly stipend at the rate of Rs.3,000/- (rupees three thousand only) for a period of 12 months to those who satisfy the requirements specified in “Kerala Advocates’ Stipend Rules, 2021”. You may advice the members of your bar having practice below 3 years and who are below 30 years of age, annual income of less than Rs.1 lakh, and who has remitted subscription to the KAWF up to date to avail this opportunity by submitting application for stipend along with prescribed fee of Rs.100/- by way of bank challan or Demand Draft drawn in favour of KAWFTC, payable at Ernakulam, before 17.8.2022 (1st of Chingam 1198 ME). The key points for processing of the applications are the following:-
1. The member of the Fund applying for stipend shall not be a defaulter under sub- section (7) of section 15 of the Act as on the date of submission of the application.
2. The applicant shall not have exceeded three years of actual practice on the date of application from the date of the member passing the AIBE (All India Bar Examination).
3. The member shall not have attained the age of thirty years, as on the date of application.
4. An applicant, who is eligible for stipend under the Act & Rules shall submit the application for stipend in Form I, along with a fee of Rs.100/- through Demand Draft drawn in favour of KAWFTC, payable at Ernakulam, or through bank challan for remittance of the fee in the account of KAWF Trustee committee.
5. All documents to support their eligibility shall be produced in original along with the application.
6. The applicant shall fulfil the following conditions, namely:–
(a) The applicant shall be a member of the Fund and is not in default of annual subscription to the Fund under sub-section (5) of section 15 of the Act;
(b) The applicant should have successfully qualified in the All India Bar Examination on the date of application for stipend;
(c) The applicant’s annual income, at the time of application shall not exceed rupees
(d) The applicant shall, along with the application, submit an annual income certificate issued by the competent Revenue/Tax Authority, certifying that the annual income of the applicant is less than Rupees one lakh, during the financial year immediately preceding the date of making application for stipend;
(e) The applicant should not have exceeded the age of thirty years on the date of application
(f) The applicant shall, along with the application, submit a copy of the birth certificate of the applicant;
(g) The applicant should not either substantially or full time pursuing any course of study or earning substantial income from any source other than from the legal profession or part time teaching in law;
(h) The applicant shall , along with the application, submit a certificate issued in Form II by the presiding officer of the Court or Tribunal where the applicant is practicing certifying that the applicant is in actual practice at the time of making the application for stipend, along with a certificate issued by the President or Secretary of the Bar Association of which the applicant is a member, in Form III showing that the applicant is in less than three years actual practice at the Bar at the time of making the application for stipend;
(i) The application for stipend shall be forwarded through and recommended by the Bar Association, of which the applicant is a member;
(j) The applicant, for the eligibility for stipend under these rules shall submit a sworn declaration in Form IV as to the correctness of the particulars furnished in the application in Form I, and also undertaking that the applicant shall assist the Legal Services Committee constituted under the Legal Services Authorities
Act, 1987, (Central Act 39 of 1987), which is attached to the Court in which the applicant is in actual practice and shall attend whatever number of cases are allotted to and also undertake to attend, in a year at least two courses of the Refresher Courses, Seminars, Continuing Legal Education Programmes,
Professional Development Courses or Workshops conducted by the Bar Council of Kerala.
(k) The applicant shall, declare in Form V that in the event of the applicant furnishing false information in the Forms under these rules or creating false document, he/she shall be liable for criminal prosecution and suo-moto disciplinary proceedings for professional misconduct under the Advocates Act,
1961(Central Act 25 of 1961) and on grant of stipend, execute a bond in non- judicial stamp paper of value of Rupees two hundred in Form V undertaking that in the event of the applicant furnishing false information in the Forms under these rules or creating false document, the applicant shall refund the amount received as stipend till then with 12% interest per annum to the Fund.
