The enrolment fee provided under Section 24(f) of the Advocates Act, 1961 is Rs. 750/- for general candidates and Rs. 125/- for SC / ST candidates. Enrolment application will be received on remittance of the said fee.
As per Certificate and Place of Practice Rules, 2015 of the Bar Council of India and its directions dated 28.01.2017, it is mandatory that Degree Certificates be got verified from the Universities concerned. It is also mandatory to get antecedent verification from the Police authorities concerned as per direction of the Hon’ble High Court of Madras and direction from the Bar Council of India dated 23.01.2018.
As per Rule 40 in Chapter II, Part IV of Bar Council of India Rules, every Advocate is to pay Rs. 600/- per year or a consolidated life time payment of Rs. 3,000/- to the Bar Council of India which is to be utilized for welfare of Advocates. As per Rule 42, failure to pay the yearly subscription of Rs. 600/- will attract order of suspension of right to practice.
In pursuance of provision under Section 6(2)(a) of the Advocates Act, the Bar Council of Kerala have constituted Chairman’s Relief Fund to provide immediate relief to needy Advocates for major medical treatments for which Rs. 1000/- is collected. The Bar Council of Kerala is regularly organizing Continuing Legal Education programmes and providing Advocates Act Book as mandated under Section 6(1)(ee) of the Advocates Act for which Rs. 3250/- is collected. The Bar Council of Kerala is also collecting charges towards enrolment certificates, identity card, photo and video-graphs of enrolment function, application fee, registration fee etc. All these are optional. Only those candidates who pay the optional fees will be provided with the above services of the Bar Council.
Those candidates who are retired from service will have to pay the requisite fee. Candidates who apply for enrolment after five / ten years of passing LL.B shall also pay the requisite fee. The candidates applying for re-enrolment shall also have to pay the requisite fee.
The enrolment fee of Rs. 750/- is fixed as per interim order dated 15.02.2023 in Writ Petition (Civil) No. 3068 of 2023 of the Hon’ble High Court of Kerala in which it is specifically stated that payment for enrolment will be subject to the final result of the writ petition. The Hon’ble Supreme Court has directed the Bar Council of India in WPC No. 352 of 2023 to formulate a common fee for all State Bar Councils for enrolment.
All payments by candidates for enrolment will be subject to the final order in WPC No. 352 of 2023 of the Hon’ble Supreme Court and WPC No. 3068 of 2023 of the Hon’ble High Court of Kerala and further directions from the Bar Council of India. Those who pay the statutory fee of Rs.750/- / Rs.125/- will be liable to pay the balance amount if the courts so direct at the time of final disposal of the W.P. (C) 352 of 2023 and 3068 of 2023.
